The rules and regulations around intellectual property rights can be very complex and also very confusing which is why you do not need be an expert, but you do need to have a basic level understanding of the fundamentals around these laws. We caught up with industry expert when it comes to intellectual property Michael E Melton, to find out why this it is important that you know about these laws, and what makes up the four corners of these rights.  

Why It Is Important

The reason why it is vital that business owners have an understanding abut intellectual property laws is for reasons of protection. If a business were to infringe upon the rights of another, using something that they have created for the benefit of their business, there are some heavy consequences which may occur. In some cases this may be nothing more than a warning or a financial slap on the wrist, in other cases however the punishments can be far more severe and do great damage to your business.

Patent

A patent is one of the four cornerstones of intellectual property rights and this covers an idea, a product or a part which has been invented by someone that is entirely unique. Once someone invents something like this they can apply to have it patented which then gives them the sole rights and responsibilities in terms of permitting others to use, or reproduce their invention.

Copyright 

Copyright seeks to protect the way in which an idea is presented and whilst the idea itself may not be entirely original, the way that it is presented can be. Copyright includes aspects such as written work for literature or film, architectural drawings, written computer code, music and software. If a piece i protected by copyright it cannot be used in the same way by anyone else.

Trademark

Trademark refers to signs, symbols, logos, smells, phrases and color schemes which are created by a company with the idea of using them to identify the company. For example the McDonald’s slogan ‘I’m loving it’ is a trademarked slogan which cannot be sued by anyone else.

Trade Secret

If information about processes, strategy, formula or devices is stolen from a business and used by another then this is considered to be against the Trade Secrets act, put in place to prevent this from occurring. A business will have to protect itself of course but if theft happens then they are covered.

Bonus – Unfair Competition

Unfair competition also falls within the intellectual property law and it prevents businesses from using foul play to gain an advantage over its competition. This could include practices such as trade defamation, copyright infringement, misrepresentation of an image or name or even false advertising.

Andrew Curran Wesleyan University Professor, The Art of Great Debate

Debating is something which is fast becoming a dying art and we now live in a world which is full of people with complaint but without any real rationale or thought process behind having an actual debate. It often seems that people like to tell the world what they think and if there is any retaliation they begin to make it personal. It is for this reason that I consider myself very lucky to have been taught by Andrew Curran Wesleyan university professor and someone who was always keen for us to debate a wide range of topics. Like myself Andrew was from New Haven, Hartford, CT and in a place like that you need to have your wits about you, probably why he was a great debater. I may not have appreciated it at the time but what Andrew Curran showed us in debating, set us up very well for life.

Confidence

For Andrew Curran Wesleyan students all had outstanding potential and he would work very hard with us to help us realize that potential. One thing which debating always did was to help you become more confident and whether discussing a lawsuit or a topic such as abortion, standing up in front of your peers and arguing is something which will give you a great deal of confidence.

All Angles

It is now much clearer to me that what Andrew was seeking to achieve through the numerous debates which we had was to help us to understand how to view an argument from all sides. If you are arguing for example that email is responsible for the poor level of handwriting in today’s world, you need to understand the argument against, so that you can prepare a rebuttal. Once you are able to understand another side to an argument you can form opinions far easier and it actually breeds empathy in you as well.

Public Speaking

Not everyone feels naturally confident when speaking in public but there are a great many jobs in which it is absolutely necessary, no less than working in the legal system. This is often why Andrew would have us debate in front of everyone and in doing so we would learn an awful lot about body language, rhythm of voice, tone, annunciation and even down to the pauses which we would take. This experience certainly helped us all to feel more confident when speaking in public.

Losing and Winning

Losing and winning in sport is very different from losing and winning in a debate and you must learn how to do both with dignity and with class. Losing an argument is almost more frustrating than losing anything else, especially when you remember points at a later date which you wanted to have made. All of this however is part of the learning and as you debate more and more, you begin to find the ways in which to win.

Why Pearls Are Emerging as The Next Big Fashion Statement

Pearls have been around for thousands of years and their popularity only seems to be increasing. In fact, in many bridal fashion shows in the year gone by, pearls dominated the clothes and accessories of the models. Young people are also taking to pearls in a big way. Why is it that pearls are fast emerging as the next big fashion statement?

One of the most obvious places to see a renewed love for pearls is in bridal wear. Weddings happen all the time and brides have embraced the pearl trend in their clothes. Whether it’s on the gown, the jacket for the reception or the veil, pearls have made their presence felt. We also see it in bridal jewellery. A pair of simple earrings with Akoya pearls or a strand or two of pearls enhance the beauty of the attire even more. Maybe the appeal lies in its timelessness. Every bride wants her wedding gown to be fashion-forward even decades later. Pearls never age and therefore it makes sense for the wedding gown to incorporate them.

Pearls are a great piece of jewellery to possess. Imagine a simple bracelet or choker. Perhaps a strand of multi-coloured pearls and some drop earrings. Pearl jewellery is classy and elegant, but also modern and trendy. This is one of the reasons why pearls are so popular with youngsters. They can wear them and look cool. For instance, a choker looks great with a pair of jeans and with a dress. Its versatility makes pearls a popular choice.

While the pearl is a precious stone, it is rarer than almost all the stones known to man. This makes it an object to covet. In fact, the Tahitian pearls and South Sea pearls are massively popular today. There is a huge demand for them because there’s more spending power and a greater knowledge of these things. The world yearns for the rare find, the rare experience. The saltwater pearls fit this bill to a ‘T’. They are a conversation starter and a statement maker.

Pearls lend themselves to everything- you can use pearls as embellishments in jackets, skirts and dresses. A pearl-encrusted bag, shoes and heels are a good addition to a closet. Pearls are a great material to work with as well. They are hardy and can be extended to be part of artefacts and furniture. Imagine a console table with mother of pearl inlays. Or a photo frame with pearl accents. There is a lot you can do with pearls beyond jewellery.

Celebrities are also doing their part to increase the demand for jewellery. Natalie Portman played Jacqueline Kennedy in a movie and her fans found the pearls she sported wonderful. Reality star, Kim Kardashian and her daughter wore pearls too in a popular photograph. Pearls are seen in the music festival and concert costumes of stars, on the red carpet and award shows too. All this has enhanced the image of the pearl in people’s minds.

The pearl is a perfect legacy gift too. It’s often bought keeping the future in mind- making it eternally fashionable and trendy.

Responding to the Changing face of Business Today

If you have been out of the business world quite some time and re-enter it today, you might not recognize many of the things that you see as being normal business activities. Today’s top business Executives like Louis Gonzalez Jr. Understand how to navigate this environment to the greatest benefit.

From the look of today’s offices that are wide open what fuel private offices in more common spaces. With their ergonomic furniture, cafe latte stations, and areas for employees to distress, many of today’s offices feel like Resorts rather than work environments.

In terms of employees, more and more are temporary and are actually employees of a temporary staffing firm rather than the actual company with it working. Of the hired employees I’m a good percentage of them actually work from home I may not going to your office more than once or twice a month. They utilize today’s top mobile technology to stay connected to the office, customers, vendors and other employees

Pertaining to customers, is not uncommon to have a majority of your customers be ones that you have never actually met in person, but only had VoIP telephone conversations. Many of these conversations are now translated on the Fly because your customers don’t speak your language.

As far as business models and revenue generation, the company might have large investments in assets that only greater foundation for the company but that do not directly generate a new Revenue. Instead the revenue might come from Equity sales made possible by soaring valuations.

For someone entering this new business world, things can be pretty terrifying. For such dramatic changes, anyone looking to be successful today common needs to make some pretty large adjustments. Here are a few suggestions call me if you find yourself in this situation.

Get Used to Mobile

It may be difficult for more traditional business executives to accept, but today many organizations run their businesses true mobile smartphone. They do everything from sending files, interacting with customers, exchanging internal Communications, and sending and receiving invoices without ever interacting with a laptop or desktop computer. This allows for companies to focus their energy on products, services and customers instead of upgrading in updating business tools constantly. In many cases they utilize software that is completely only controlled by other companies but accessible to them. This new mobile world offers the type of benefits that precludes today’s business people from going back to the old ways.

Think Globally

The age of a local company is dead. Today every business has a desire and capability to be a global Enterprise. And every business has to think this way because every other business is looking to get into your markets to sell to your customers. Gone are the days when companies such a b small and great. Now you must service both St Louis Missouri and Shenzhen China with the same level of enthusiasm and professionalism. The payoff if you can do this is hyper growth and a healthy bottom line.

Listening With Purpose To Be A Better Manager

The best managers in the world understand different things that others do not. One of them is that every single person you will ever meet will know something a lot better than you. This is why great managers like German Trujillo Manrique make it a habit to actively listen. Unfortunately, most people out there do not know much about this and even if they think they listen, this is not what actually happens.

Human beings do not just want others to listen. They want to also be understood. This offers a high sense of freedom and value. In a business environment this is highly important since it empowers people to actually express themselves. If another person does not listen to us, we naturally end up feeling minimized and impeded.

Every single manager needs to be aware of what listening is and how important it is. It is possible that you know a lot more than the person that you talk to. Even so, it is impossible to know exactly what the other person knows. Understanding can be vital to what is necessary to complete a thought or even a project. This is why it is always in your best interest to offer people the possibility to actively contribute. As you listen to those that are around you and you have the presupposition that you know everything, both you and the other person end up in a situation in which improper communication is in place.

Managers have to work with different people that come from different backgrounds. It is common to see that communication is not proper simply because of different interests. When people have different interests it is easy to think that conversation would be boring. Those exact people can have some really interesting perspectives that cannot be developed alone. By simply thinking that you have nothing to learn you can end up losing valuable information that will make everything a lot better in the future for both you and the business.

What is particularly important is to be sure that you listen with a true purpose. Actively listening is not the same thing as just listening, contrary to what you might think right now. It does not matter if you are a manager or just a team member that listens to the indications of a manager. You need to be sure that you actually listen to what others say. This automatically means being aware of what is said actually means.

Remember that active listening might seem to be what you are doing but it involves so much more than what you initially believe. For instance, active listening also means looking at the person that is in front of you so you can see body language reactions.

On the whole, as a manager and even as a leader, be sure that you do all that you can in order to understand what listening actually is. You need to be careful and never just listen without being aware of what the other people are saying.

Most people will learn about them through personal experience or by participating at an event held by an organization like National Youth Leadership Forum. If you cannot get the knowledge through such options, you need to start learning alone. Everything starts by being aware of common leadership mistakes that have to be avoided at all costs.

Not Offering Feedback

Many business owners and managers wait until scheduled performance review until they tell employees of potentially negative behavior. This can be a huge mistake. If feedback is not provided as soon as possible, a mistake is made. As you provide really prompt feedback, you offer the opportunity to actually improve performance. If you delay this, the entire organization operates at a lower performance level.

Not Making Time For The Team

Every leader knows that from time to time it is so easy to simply get wrapped up in the workload that is present. Because of this, it is common to become unavailable for the team.

It is completely true that projects need to be delivered and you need to work really hard but not making time for the team is a huge potential leadership mistake that should never be made. As the leader or the manager is not available, the team does not have guidance and support. While a few projects end up delivered faster, in the long run productivity falls.

The Hands-Off Approach

Micromanagement is something that many leaders simply want to avoid as much as possible. Too much micromanagement can hurt the entire team, just like the opposite. The very best leaders manage to properly balance absolutely everything.

Over-friendly Approach

It is normal to have a desire to be seen as an approachable and friendly leader. This always leads to a much happier workforce. The problem is that making really tough decisions is also an important part of the job. There are always people that want to take full advantage of the over-friendly approach a leader has.

You should socialize with the team but be sure there is an appropriate balance between being a boss and being a friend. Clear boundaries need to be in place.

Not Defining Goals

When people do not have really clear goals, effective productivity is not a reality. It is practically impossible to be productive in the event that you do not know what goal you work towards. Every single effective leader out there uses SMART goals and manages based on objective. In this way, the team’s goals are perfectly aligned with the organization’s goals.

Not Properly Understanding Motivation

A huge leadership mistake is to think that only money motivates a team. Monetary rewards are a huge part of the equation but there are surely many other things that have to be considered. As an example, there are many cases in which motivation is higher as a good work-life balance is achieved. If this is the case, you might want to consider some levels of telecommuting.

How Tatiana Regan Makes Her Money Online

For just over 5 years now my good friend Tatiana Regan has been making a living online and has managed to forge a very nice lifestyle for herself. To be completely honest whilst the rest of us went off to start our careers after college Tatiana Regan was convinced that she wouldn’t join the rat race and so she started to explore ways ind hick she could make money on the internet. Tatiana struggled in the early years which I imagine is very normal but now she makes a very good living indeed. Probably the most boring of her jobs but nonetheless one which has always paid is online surveys and Tatiana Regan has been filling them out since she very first started to try and make money online. Basically these surveys are paid for big businesses and governments in order to further understand their demographic. The surveys are put online by third party websites who will pay you a small amount for each survey completed. Tatiana never got rich from this of course but it always brought in enough money to keep things ticking over.

Writing

After trying for a long time to get stable clients Tatiana was able to gradually get clients who offered her writing gigs, a great way in which she was able to make money. Tatiana was writing for all kinds of clients across the internet, usually writing content for websites and online magazines. She found much of this work on freelance site Upwork and she used that platform to find clients who she could work with long term. The writing side of the business was how Tatiana was able to earn enough money to have a comfortable lifestyle and it also gave her the freedom to then launch her own business. For anyone who wants to carve out a living online, writing content is the very best place to start.

Drop Shipping

On the face of it drop shipping sounds too good to be true but as I have seen with Tatiana, it is a very real and very profitable way of running a business. Tatiana sells tech gadgets online and she has a beautiful website from which she sells the goods. The difference with most businesses however is that Tatiana never touches the goods, never sees the goods and never speaks with the clients. The reason for this is that once the order is processed it is handled by another company who deal with all of the shipping and customer service. Tatiana sells products for a higher price than she pays to this 3rd party and that is how she now makes her money. It sounds very simple in reality.

There are many ways in which you can make money online, you just need to give it a try like Tatiana did.
